TERMS ONLY RELATING TO BUYERS DEALING AS CONSUMERS
Once a contract has come into existence between the Supplier and a Consumer, Charles Edwards® (Antiques) Ltd. shall only be entitled to terminate the contract if the Consumer is in material breach of the contract or enters into insolvency, bankruptcy, any arrangement with its creditors or any other arrangement or situation which has a like effect. This termination will take effect without notice.
Customers dealing, as Consumers do not have the right to cancel a contract as the goods are deemed personalized goods made to the Customers specifications. This is in compliance with the prevailing conditions of the Distance Selling Regulations 2000.
Customers dealing as Consumers are required to inspect the Goods for the purpose of ascertaining whether or not at the time of delivery they are defective. Customers acting as Consumers are required to notify Charles Edwards® (Antiques) Ltd. as soon as is reasonably practical in the event that the Goods are found on inspection to be defective Charles Edwards® (Antiques) Ltd. do not accept any liability for Goods damaged in transit.
The items are manufactured and/or finished specifically to order and to the Customer's requirements. In the event that the order is no longer required, you may return part/whole of the order to us to be sold on your behalf. You must inform us in writing within 7 days of receipt of the order of your intention to return an item(s). Any fixtures must be returned within 4 weeks of collection/delivery and in perfect condition at the customer’s expense. We will endeavor to sell the items on your behalf, however we do not guarantee a sale. Upon sale of the item(s) a commission of 25% will be taken from the sale price. All items will be sold at the price of purchase.
Once an item is sold you will be entitled to a refund less the commission charge. If however we have not managed to sell the item(s) within 3 months of its return, we will contact you to request that you collect the item(s) from our workshop or incur storage charges of £30.00 per item, per week until you do so or until the item is sold.
We cannot offer any recourse for items that are custom sized or bespoke.
Customers dealing as consumers have other rights granted by law in addition to those set out in these terms and conditions, which the Supplier cannot exclude. These terms and conditions do not affect those other rights granted by law.
TERMS RELATING TO BUYERS NOT DEALING AS CONSUMERS, including interior designers and architects.
The items are manufactured and/or finished specifically to order and to your customer's requirements. Recourse for return, including sale of behalf of goods will not be given. This does not affect your rights under the Charles Edwards warranty for defective goods.
